New residency card for British citizens (TIE)
The United Kingdom left the European Union on 31st January 2020 and a transitional period is now in force until the end of this year, by virtue of the so-called withdrawal agreement.
As a result, the process for UK citizens and their families to obtain their residence permit (TIE) under the withdrawal agreement is in place from July 6th to the deadline of December 31st.
This process aims to avoid the requirements that will be imposed on British nationals as third country nationals after the end of the transitional period and, consequently, their treatment as non-EU nationals from next year.
Therefore, for any British resident in Spain, whether they already have an EU citizen card or are applying for it for the first time, obtaining the TIE (Identity Card for Foreign Nationals) is a requirement to be fulfilled before the end of 2020.
The requirements established vary according to the situation of the applicant, and can be divided into the following cases:
- British citizens with EU Registration Certificate who have not reached 5 years of legal residence.
- British citizens with a temporary EU Registration Certificate who have reached 5 years of legal residence.
- British citizens with EU Permanent Registration Certificate.
- British citizens who do not have an EU Registration Certificate.
- New card for family members of British citizens (with or without EU card).
In the case of British citizens who already have an EU certificate (temporary or permanent) the process will continue to be carried out at the police station corresponding to the domicile of the applicant in Spain.
On the other hand, those British citizens applying for residence in Spain for the first time must process their application at the foreigner’s office of the province where they reside or where they intend to establish their residence, for which they must prove compliance with the economic, health coverage and municipal registration requirements established by law, as well as the provision of documentation proving their effective residence in Spain or those linked to the activity they have been carrying out in our country in the case of those employed or self-employed.
